Long years Residence (10 years)

Post by RAJ2007 » Mon Jul 30, 2007 1:14 pm

My friend is on student visa. He is living in uk continuously legally for 10 years.
1. How days before the completion of 10 years period he could apply for ILR? Is it max. upto 28 days before the completion of 10 years he could apply? Other than passports is there anything else he needs to send (like bank statement, payslip)?

2. His wife is also living with him for 10years, could he apply seperately on her own right for ILR?

3. They have one son (born in UK) age 5years. Could he apply for registration (MN1) after the parents obtain ILR? Also, instead of applying for ILR, could he directly apply for Registraion ( as because his parents has got ILR). Is Registration (MN1) and citizenship same?

4. How long it takes normally for to register a child (MN1)?

28 days in advance if applying by post. If there are continuous visas then no other documentation is really necessary.

Thanks for your reply Victoria.

1. Is registration (MN1) and citizenship same?

Also, if anyone else could say, how long it takes to register child?

According to the Home Office, it's 2.5 months.

Registration on form MN1 is one way of acquiring British citizenship. If the application is successful, child will receive a Certificate of Registration as a British citizen.

In fact an application under section 1(3) of the Act would be even quicker. Most "minor registrations" are linked to naturalisation applications.

Stand-alone registrations are processed more quickly. 4-6 weeks is a more typical timescale if all documentation is provided and the application is otherwise straightforward.
