Need urgent advice please

Post by enrules » Mon Jul 14, 2014 2:53 pm

I am on a Tier 2 visa and have a PEO for ILR on 18th June. I was on student visa till 17th August 2009 when I switched to Tier 2 visa and have been on Tier 2 since then. Therefore my qualifying period starts on 17th August 2009. I realised the 28 day rule means I can apply 28 days before I reach 5 years so is 18th June ok (now that I have already booked and paid for it? Its 2 days short of 28 days or is it up to the case worker's discretion? Would appreciate your help.

Thanks

Nope. 28 days is 28 days, not 30 days. Can you change the appointment date?

They may hold processing your application for 2 days if they wish.
