Switch to Tier 4 and then Tier 2 again after course complete

Post by cahusr123 » Sun Mar 30, 2014 12:43 pm

Hi,

I am currently on Tier 2 General (employer sponsored) visa and I may not be able to continue working for my currrent employer due to various reasons. I am looking for an alternate Tier 2 sponsor. However In the event of not getting the same I am considering switching to Tier 4 student. I have some questions and need your help

1. Can I switch in country from Tier 2 General (employer sponsored) to Tier 4 Student in country?

2. Can I switch back from Tier 4 Student to Tier 2 General (employer sponsored) again in country later on when my course is successfully completed?

So far my history is

1. Entered into UK - July 2010 in Tier 4 Student visa
2 Switched to PSW in Nov 2011 in country
3 Switched to Tier 2 General (employer sponsored) in July 2013 in country

Thanking you for your reply.

Regards
C

You can switch into tier 4 in country.
However should you get a new sponsor you CANNOT switch back to tier 2. .....you need to go back to your country and serve one year cooling off period before coming back to the uk.

Hi Apam, thanks for your reply. I was looking at the tier 2 guidance and could not find any information for cooling off period as I was just looking at whether a Tier4 student can switch to Tier2 in country irrespective of what Visa they have held before their current Tier 4. Can you please point me to where I can get more information about cooling off period please? As I need to make some quick decisions. Thanks!

I have found one more piece of Information which is contradicting what Apam has replied however I do not know the validity of this

https://www.gov.uk/government/uploads/s ... as-soi.pdf

To prevent repeat grants of temporary leave, Tier
2 migrants will be subject to a ‘cooling off period’.
Those who leave the UK without qualifying for
settlement will need to wait for 12 months from the
expiry of their leave before re-applying to Tier 2.
Equally, those who switch into another category of
leave while in the UK will not be able to re-apply for
leave as a Tier 2 General migrant until 12 months after
their last leave as a Tier 2 migrant has expired.

So If you read from the statement that begins with Equally, what I understood it means is that -
If I switch from Tier 2 now to Tier 4 and then switch back into Tier 2 after twelve months I can do all these without leaving the country ?

Dear Admins / Gurus, Please advice in this matter????
