Tier 2 extension while my ILR decision is pending

I have applied for ILR Under TIER 2 Migrant a couple of months ago, the ILR waiting time is close to 6 months, meanwhile I've got my passport and the old BRP card from the HO, whereas the ILR DECISION is still pending. In the next three weeks my Tier 2 visa will expire.

I just want to know if I can apply for tier 2 extension while my ILR decision is pending ?

The simple answer is no.
You can only have one visa application live at any one time.
While your ILR visa idecision s pending even after the current tier2 expiry date you will still have valid leave under tier2.
The negative side of this is that you cant leave the UK while the decision is pending.

I've applied ILR only for myself and not for my family , what would be their status as their existing tier 2 is valid only for three weeks?

All leave remains valid by means of an extension of stay under 3C. Your rights i.e. to work remain the same until a decision is made.

Amber i think the OP is saying he has not applied for the dependents and their leave will be ending in 3 weeks..
I think he needs to apply for dependents extension before their current leave expires with a cover letter explaining that the main applicant application for ilr is under consideration..

Is your wife eligible for ILR? were your kids born in uk?

Yes , my family and kids are eligible for ILR

Thanks Amber, do you mean that I have to extend for my family and I should wait till the ILR decision? OR Since my company is sponsoring , can I extend for myself as well by providing my ILR REFERENCE number in the tier 2 extension application form ? ( there is section in the form to specify).
