EEA2 Unmarried Partner visa rights

Post by TimoK » Mon Sep 22, 2014 5:38 pm

Dear Sirs/Madams,
I hope this finds you well.

I am a EU citizen who has graduated from Queen Mary UOL (Sep 2010-Sep 2013) and now I am working and have settled in the London. My partner is a Turkish citizen and she has recently graduated from Queen Mary University of London- Aerospace Engineering degree (Sep 2010-Sep 2014). My partner has been living and studying in UK for over 4 years and we have been living together for over 2 years. Our relationship has began just over 3 years ago.

We have our names on the same tenancy agreement since 01/09/2013 for a one year period. We have recently resigned our contract until September 2015. We have our names on all bills, etc.

Between Sep 2012 and Sep 2013 we were also living together, but the property, bills, etc was on my name and another flatmate. On the positive, we have a couple of invoices of products my partner ordered to the property at the time. I could also request my flatmate at the time and the landlord of the property to testify that we were living together for that period.

1.May I ask you if that would be enough and if not, what else we could do?

2.Would she have the right the work in the UK if she obtains the EEA2 visa and what would be her status and rights in general?

3. Is there any other sources of evidence we can provide?

Please do let me know if there is anything that could be done in this situation, her current student visa expires on 19th of October. We are very scared that she might need to leave the country.

I look forward to hearing from you.
Many Thanks,
Timo

You stand a fair chance as EU rules only stipulate evidence of a 'durable relationship' not a specific length of time, unlike UK regulations.
