FLR(M) Query: Living with your sponsor

Post by Ineedyouradvice » Tue Sep 30, 2014 9:44 pm

Hello,

I am currently in UK on Tier 2 visa and working on client site in Scotland. Last week I got married in UK. My husband has ILR visa. I am planning to apply for spouse visa next month (on 28th Oct 2014). This will be my first application for spouse visa in UK.

I rent a flat in Scotland near my place of work. My husband lives (in rented accommodation) and works in London. It is not possible to undertake daily commute to Scotland from London, and therefore we have agreed to retain both residences. Following our wedding, during the working week, I plan to live in Scotland, and every second weekend with my spouse either here in Scotland or at his home in London. On completion of my current work assignment in Scotland (i.e by end of Nov 2014), it is our intention to reside together in London, which will then be our main residence.

My question:
Is there any concern that after marriage I am not living with my husband?
Is my above justification for not living together sufficient for the Hone Office?
Section 6 : 6.6 Do you and your sponsor currently live together? Can I say in the application form that I live with my husband even though its only on weekends?

Thank you!

Thank you!

If you explain thing as you do now, then i strongly believe you will be fine, as there are clear and valid reasons for your living apart.

This is intention to live together, which is what the rules require.

I am filling the FLR-M form and have few questions:

After marriage I will be living seperately in my rented flat in Scotland and my husband will be living in his rented flat in London. We will not be including each other's name on our existing tenancy agreement for the time we are living seperate.Currently we will be meeting/staying with each other on weekends only. Once my work contract ends in Scotland, I will move to London and start living with my husband and thats when he will include my name in his tenancy agreement.

I would need your help for the below question in the Application form:

6.6 Do you and your sponsor currently live together?

Ans: I would say yes. But am not sure if staying togther on weekends only counts as living together.

6.19 Where do you plan to live together in the UK? and also 7.8 Where do you and your sponsor plan to live in the UK

Ans: Should I mention my husbands london address? I was thinking of including a note here to refer to section 7c (where you can provide further details realting to your financial situation or accomodation arrangements). Its here that I would be explaining my situation and reason for living with my husband only on weekends and not on weekdays.

Thank you!

Why not just put address of where you consider as home, telling them you won't be living together can confuse an ECO. Working in different places is non issue.
You really don't need the explanation, except you want them to think there's more to it really.

Thanks Rayking for your response. I understand your point.

I can state my husbands address, where I plan to stay. Do I need to provide, as supporting document for my visa application, the tenancy agreement stating my name along with my husbands name?

I havent see such requirement.

This is my first application for Spouse visa so I undersatnd I do not need to provide 6 items of corresponsdence addressed to me and my sponsor for the address where we live together.

For this reason I ask if I need to provide tenancy agreement as a proof of residence with my sponsor.

The form has 71 wages, there are areas in it, where you will have to deal with these issues.

If you have it you can,but there's no requirement that your name needs to appear on it and there's no requirement you should live together before marriage.
