Is ILR stopped after 2018 April for Tier 2(G) too ?

Post by tier2struggler » Sat Nov 29, 2014 8:20 pm

Hi expert,
I was planning to apply for Tier 2(G) from india and was discussing the same with my friend in UK.
He told me that ILR is stopped in UK after 2018 april and you better try for other country where long term opportunity available.
Is it correct ?
And after 2018 april, everyone has to come back to their home country ?
I could not find these guidelines in UK gov website.
Could you please suggest me whether it's good to apply for tier 2 or not from long term prospective ?
If the above information is correct, please refer me to correct link so that I can understand everything before applying.
Please suggest.

Your Friend's understanding is wrong. ILR route is only stopped for Tier 1 category only after 2018. ILR route with 5 years on Tier 2 General is still open.

Your friend might be on Tier 1 category

This rule is mainly because Home office is now closing down Tier 1 General Category, so they are putting a limit of time till when it will be in existence.

Just check part 6A document of immigration rules released on 6th Nov 2014. Check for section Tier 1 General Migrants 245CA(h). it clearly says

(h) The application for leave to remain must have been made before 6 April 2015.

Also for ILR route through Tier 1 the rule is in section 245CD(m) says:

(m) The application for indefinite leave to remain must have been made before 6 April 2018.

There are no such requirements on Tier 2 General category in Part 6A document released on 6th Nov 2014.

Thanks ravi_ei for informative message. It has cleared my confusion and I can undoubtedly apply for Tier 2 visa.
Thanks again for your valuable suggestion.
