Hi All,

appreciate your kind answer for the below issue,

applied for UK Spouse visa on 2012 before the new rule come into effect ,application refused but appeal is allowed on july 2013. it says

Appeal allowed under immigrations law
Human right allowed under article 8
Visa granted for 27 Months

Is my visa issued under the old rule or new rule if its in old rule, can i apply for ILR 28 days before of my visa expiration or 28 days before completion of 2 years. waiting for your kind reply thanks

its the date of initial application that matters . You will be eligible for indefinite leave to remain under old rules. Your appleal was allowed so it means the decision to refuse you was wrong.

If the initial application was Pre July 2012, then you are under the old rules. The visa will be issued for 27 months (including a 3 months grace period to allow travel to the UK).

Probationary period will be 2 years (as per old rules) and will be eligible to apply for ILR at 28 days prior to completing the 2 year period.

Thanks to both of you for your useful info much appreciateed.

I will be grateful if any one tell me about the financial requirements of ILR under old rule as I haven't worked continuously since I came in this country and paid very less tax and NI but recently I got a permanent job offer which will start 4 months before my ILR application but my wife has a permanent contract since I came to this country and also if you help me with a brief list of required doc and type of form used. Thanks in advance for all your valuable info. Waiting to hear from you guys.thanks
