UK Work Permit Holder - Eligible for Australian PR?

Post by SaraM » Thu Sep 20, 2007 3:55 pm

Hi,

I am an Indian working in the UK on a work permit. I have been here for 3 years. I plan to apply for an Australian PR. Will this affect my work permit here in the UK? I dont want my current work permit to be affected.

Please let me know your views.

Thanks!
Sara

No, I don't think it will affect your work permit in the UK per se. However, if your Australian visa is granted you will have trouble keeping both "active", although that is not necessarily what you're wanting to do, of course. But in the worst-case scenario that your Australian application is unsuccessful then I don't believe the fact that you made the application would have any negative effect on your status in the UK.

Thanks a lot for the information. But what is meant by 'active'? If I get my Australian PR, can I continue in this country for the next 1 or 2 years and then relocate to Australia.

Thanks.

As long as you enter Australia within the time limit on the Australian visa, I can't see why it would be a problem. What I meant by 'keeping them both "active"' was trying to retain legal residence (from an immigration point of view) in the two countries - but it doesn't sound as if you're wanting to do that anyway.

Australian PR visa does not have an expiry date, however, it does have an inital entry date, by which you must enter Australia to validate and register your visa. After validation, you can leave and then re-enter Australia at any time whenever you want.
You can still continue working in the UK on your WP as long as you wish and still keep your Australian PR at the same time. However, if you leave your employer in the UK for Australia, your WP UK will cease and should you wish to return to the UK in the future, you will need to obtain another UK Work Permit and entry clearance.
