Came to UK on 5th March 2005. Stayed in UK in tier 4 visa until October 2013 and tried to Switch to tier 2 within the time but got refused visa as I had done ACCA and they didn't accept it as a British bachelors degree. Appealed. First tier tribunal approved my appeal but upper tribunal dismissed my appeal. Appealed again in the court of appeal. Case still pending but it's already been 10 years now. Have two kids 6 and 4 who were born here too. Can I apply for ILR in the basis of 10 year long residency or they consider it as a break from October 2013 from the point my visa got rejected?
