Thought I would post this here, as I may get more views.

I am traveling to India in October to get married & would like to know a couple of things.

Do I need to register my marriage in addition to the traditional / religious ceremony so that I can apply for a settlement visa for my wife to come back with me to the UK? If so, can this be done before the Nikkah (traditional / religious) ceremony?

Secondly, I will be arriving in India on the 29th October and returning to the UK on the 19th November. The Nikkah (traditional / religious) ceremony will be taking place on the 4th November & then I am traveling to Delhi for a week. This means that I will not have much time from handing the application in to flying back home (if the application is handed in on Monday 5th Nov). Is there any process that would allow me to launch the application, provisionally, the day I arrive so that I have a better chance of getting an interview date (if needed) before I fly back, giving me the chance to bring my wife back to the UK with me? This is assuming the application is successful, however.

Any advice would be appreciated.

You do need to register the marriage - the Nikkah will not suffice. You can do it before the Nikkah, and then submit the application immediately - you don't have to wait for the Nikkah. However, it would then be a good idea to submit some evidence of the Nikkah after it has taken place.

I think it is unlikely this can be done before you travel back to the UK, as she would have to have the medical and called in for fingerprinting, which takes time.

Thanks for the prompt reply, would submitting the application before the Nikkah weaken the application at all?

I thought if I can register the marrige in the first week & submit, I may have more of a chance of getting either an answer or interviee date before I fly back?

I really think that your chances of getting an interview this quickly are next to nil. The HC is closed for a couple of weeks this month so they are going to be stcuk with a backlog.

The only problem with applying before the Nikkah is that I have seen a couple of refuals where they doubt the 'legal' part of the ceremony is a genuine legal wedding because it is usually more low key, as the religious ceremony is considered the important bit. This, of course, gets overturned on appeal, but it is something to bear in mind.

Thanks again for the reply, I think I will take your advice and launch after the nikkah. Ill register in the first week but wait till the nikkah is done and then launch. One last thing, I have prepared a file with the following:

1. Birth Certificate & Passport copies (not attested)
2. 5 Payslips from current job and 1 from previous job & 1 P60
3. Property inspection Report (independently verified) & copy of title deeds.
4. Bank account statements, Savings account statements, Mortgage account statements (6months)
5. 3 months Utility bills
6. mortgage annual statement
7. Letters received, Cards received, Parcels received from my future spouse
8. Text SMS sent to her
9. Gifs & Parcel sent receipts
10. Photos she has sent me of herself.

Is there anything else that I need or would strengthen my file apart from wedding photos and both register & nikkah certificates (if you get one for each). Any advice would be appreciated.

thanks for the reply, do i also have to get a copy of my passport & bith cert attested by a solicitor? Some people ive asked say I do while others say just a copy will do.

Hi Victoria/Fizz,

I am in the same situation and I need a bit of help.

I am going back home from 9th Nov to 17th Nov thinking it only takes 2 to 3 business days for them to make a decision. The UK embassy customer service confirmed it doesn't take more than 3 days to know the status and they don't always call for interview if the file is strong enough. Is it okay or I need to reconsider anything?

I am having slight problem in getting the following documents from mentioned by Fizz. Are they absolutely necessary?

Property inspection Report (independently verified) & copy of title deeds.
3 months Utility bills
Letters received, Cards received, Parcels received from my future spouse
Text SMS sent to her
Photos she has sent me of herself.

Victoria, I have been promotted as a natuaral progression from Compliance manager to QA manager. The company resubmitted the application to UK Embassy and got the permission to continue on the same work permit. Do I have to submit all those documents as well?

Also, do I need to get a letter from my employer confirming that I am currently employed and carry on my employment with them? Isn't the salary slip indicating the same with continuous work permit for 5 years?

I am really getting worried looking at different communications and think do I need to appoint a solicitor as I don't want to take a chance.

Please advise.
