Tier 2 General Dependant Visa When License suspended

Hi,
I am new to this forum, please excuse if I am posting in the wrong section. If my wife visits UK on Family visitors visa and then at a later point in time goes back to India and apply for tier 2 dependent visa will that be fine or is there a cooling off period involved in between. Would really appreciate an early response.

Also is it required to wait for the visitor visa to expire before making a new tier 2 dependent application.

Note that she cannot apply for a family visitor visa since you are not permanently settled in UK. She will have to apply for a normal visitor visa. If she does that, its easy to conclude that she is not coming here for tourism purposes. I hope you have a very strong reason to go that route. Personally, I would not recommend. End of the day, is your call.

To answer you other queries:
- There is no cooling off applicable if she want to change to Tier 2 dependent.
- She can apply anytime during her previous visa duration. Note that she has to go back to India and apply from there.

Thanks a lot for your advice moonlight much appreciated advice will stick to it. Just
another quick one as mentioned above if the companies licence is suspended can the dependent visa still be applied without
using companies COS. Is it still risky as the main persons visa sponserers licence is suspended?

No, you cannot. The application will be put on hold until a decision is made on the licence. You may not want to block your dependent's passport at the embassy.

As I said earlier, they can very well apply for a visitor visa. However, in the application where they ask do you have any relatives in UK, do ensure you reply correctly. Not disclosing information will lead to refusal. Ensure the paperwork is all fine not to give any reason for rejection.
