PBS Deo of person with ILR 10 years

Post by Abchardik » Fri May 08, 2015 1:14 pm

Hello

I hope I could get some help and some updated information.

I was on tier 1 General and after my second extension I completed 10 year long residense in the Uk ie. in 2013.
I then applied for the 10 year long residense ILR and got approved in 2014. I have completed 1 year to apply for British citiozenship.
Query is :
1. Got married and wife came under Tier 1 General Dependant in 2013 and she was granted visa till Feb 2016 ( 2.5 years )
2. I got ILR in 2014, but did not change my wifes status, I continued hers on Tier 1 General as it was valid till Feb 2016.
3. Now Is it wise that I apply for British Citizenship and then apply for her Dependant visa or Do I have to change her status to ILR dependant and wait 5 years form then.

Please kindly give me your expert opinions as early as possible......

Many Thanks

As you obtained ILR based on 10 years long residency, your wife will need to switch to FLR(M) and wait a further 5 years before she can apply for ILR. The time spent on PBS dep will be lost. On FLR(M), she will be issued with an initial 2.5 year visa which will need to be renewed for a further 2.5 years.

You will need to meet the financial requirement of £18,600pa and she will need English Level A1 test.

The new NHS surcharge will also need to be paid for each stage of FLR(M) (£200 per year X 2.5 = £500 and then £500 again at ext).

Spouse of person with ILR or spouse of British citizen is the same visa - FLR(M).
