Hi All,

My tier 4 visa was expired in dec 2014 after that i applied for flr(o) which was refused in March but home office gave me right of appeal at the moment i am in appeal and waiting for hearing date, my wife is tier 4 student in University and doing level 7 course and course is for 2 years, my question is can i switch to become her dependent with in the uk?

Thanks for your reply,

I have read this before and there is a little confusion about 1 thing they said " dependent must be apply at the same time" how do i apply at the same time as i just married last week and my wife already had a tier 4 visa which was issued in January 2015.

If you can give me any advise will appreciate that.

You are reading the wrong information. Look at the first two bullet points. You would qualify under the separate provision as the dependant of a Tier 4 migrant who is doing "a postgraduate level course of 12 months or longer at a publicly-funded Higher Education Institution or a 'recognised body'", assuming your wife is studying at such an institution. You are looking at the additional eligiblity for people who don't meet one of the first two bullets.

You cannot make any application while you are appealing.

I have just checked we satisfy the rule 319C (i)(ii),
Can i switch to become a dependent if we only satisfy 319C(i)(ii), what about 319C(i)(i) and 319C(i)(iii), (iv).

Hi Everyone,
I am asking a question for about 2 weeks, but did not get any clear reply I don't know much about immigration rukes that is why i am here to get any advice from senior member,
If anyone can give me clear advice i will be thankfull as i have a limited time to apply for visa.
My question is:
I am on Flr(o) appeal at the moment last status was tier 4 student my wife is tier 4 student in university studying level 7 course which is more than 12 months, am I eligible to switch to become her dependent in country.
