Am i Eligible for benefit

Hi I am in UK on ICT tier Long tem 2 work permit since 2013 and my family has joined me in Feb 2015. I have 2 kids, one of my kid who is 6 years old is disabled.

Last week i visited a school which is for these kind of kids, they advised me to apply for benefit but they were not sure whether i am entitled for this on my type work permit.

Am i entitled for all the benefits for my daughter i.e. disability allowance and other benefit ?.

Please help me on this as school is looking for all confirmation and i am not sure from where i can get this information.

Is your daughter on ILR? Or is she British? If not, you are definitely not entitled to benefit and neither is she! In my experience, British people are not really aware of what immigrants are and are not entitled to. On your visa it will say you are not entitled to benefits.

Check whether your daughter's visa states 'no recourse to Public funds'. It probably does, as will yours.

Thanks for your quick response. Have checked the visa and it is showing "No recourse to public funds" . It means i can not avail the public fund, but can i avail the school facility like Free Bus (pick and drop from home ), Chair for these kind of kids, Medical facility like physiotherapy, Language and speech therapy etc which my GP has advised. Thanks for your help again in advance.

Here's a list of Public Funds for immigration purposes. It appears that you may be free to use the services you describe.

If they were not Indian and were a different nationality, it may give them access to public funds. For example, Turkish nationals.

I would not claim any of these benefits especially if you want to avoid any issues when applying for Indefinite Leave to Remain.
Do note that they are trying to curb immigration and doing anything possible to clamp down on those who have broken rules.

The reason for this is that these benefits offered by the school might be funded by public funds offered by the Government and in the Gov.uk link shared there seems to be only one category of benefits allowed - Those as a result of NI contributions which does not seem to be related to anything that is being discussed here.

TL:DR - Avoid applying for benefits from school and avail therapy through your GP services (which is NI based). Anything not covered fork out from your own pocket to support your child.

This might save you a lot of headache in the future when applying for ILR as your application will not be a gray case then.

Is wheel chair and Transport services comes as Public fund

Hi My daughter is 7 years old, birth place is India, Have come to UK in Feb 2015 on dependent ICT tier 2 visa . She is mentally and physically disabled, can not speak, seat or do any activity.

We are planning for her schooling from September and they suggested me to apply for Wheel chair and transport services .

I a not sure whether these services comes in public fund as her visa status saying "no recourse to public fund"

Could you please guide me whether these comes in public fund or not. Thanks

NHS treatment and public education schooling are not treated as public funds.
I am not clear about transport services, it probably depends if NHS or some other body provides it.
