Switching employer under Tier 2. Does the cap apply?

Post by amamh » Tue Aug 25, 2015 12:07 am

I searched online a lot and I couldn't find the answer to this question:

If I'm already working under Tier 2 General and I want to move to a different job with a different employer who will give me another Tier 2 General. Does the immigration cap apply to me?

TL;DR Does the cap apply when switching from Tier 2 General to Tier 2 General again but with a different employer?

You'll have to make a change of employment application. if you satisfy the requirements the visa will be granted. There is no quota or cap other than a 6 year cap on the stay under T2 for those who entered T2 after 5 April 2011.

Wait, that doesn't make any sense. I thought I need to apply for a NEW Tier 2 General visa?

I've never heard about that change of employment thing? However, I did notice that the online document now says the following (which I think is new):
You may need to apply to extend your Tier 2 (General) visa application if:

you want to change your job and your new job is with a different employer
Is that related to what you 're saying?

I think I understand now.

It's just a terminology confusion. So to answer my question:

- No the quota does not apply to people switching employer under Tier 2 General.

Could you please provide a source for that, though? I cannot find anything online to state that clearly.

Thanks a lot for your help, mate

Mate, I can't even find the words "quota" or "cap" in that PDF.

Could you please point out the section that talks about the quota/cap?

Mate, manci hoped that you would read the document for your own benefit, not "Ctrl+F" it!

You are "Ctrl+F ing" the wrong words.
Ctrl+F "6 years" and you will find what you are looking for.

Absolutely no mention of the cap in any of the paragraphs with "6 years"

You have to read the document in its entirety to understand the rules. Searching for a specific phrase will not help!

For a Tier 2 General change of employment application, you need an unrestricted COS from your new employer. Unrestricted COS does not come under the restricted COS cap. As long as your employer has an unrestricted COS to assign, he can assign it to you on the same day. Even if does not have any, he can request it to UKVI which normally takes few days.
