Married last year without COA what now?

Post by ddlj420 » Mon Nov 19, 2007 9:01 pm

Hi everyone!

I came to the UK in 2003 and claimed asylum unfortunately it got rejected and I have exhausted all appeal rights. Now I made a fresh claim but have heard nothing since a year from the HO.

However, in the meantime I got married to a BC but that was done In Church without having the CoA from the HO. Due to some financial problems I couldn't apply for a COA at that time (2006). Now my husband got everything to meet the criteria to get a CoA approved. I know I have no leave to remain but thats another thing which I will sort out. So no questions about going back and getting spouse visa approved I know that all!

I just want to know if its an offence to get married in the UK without having a CoA??? Could that effect an application for spouse visa or a CoA?

If you are already legally married, then I don't see why you would have to get married to the same person again. See also Important information regarding Certificate of Approval (COA) for marriage or civil partnership applications:
5 - Religious ceremonies

5.1 The rules on certificates of approval do not currently apply if you plan to get married at an Anglican Church in England or Wales, after marriage banns or an ecclesiastical licence.

I did not marry in the Church of England. It was in a small Sikh temple(sorry I made mistake up there). The temple was really a small one so they didnt require a CoA or any other documentation.

If the Sikh temple is registered as an approved venue, then you may already be legally married.

It is likely not, as without the COA it was almost certainly a purely religious ceremony.
