hi guys,
appreciate if anyone can share thoughts/experience on the query below.

i am looking to change employer (Tier2 to Tier2). Dont expect any issues as they have met all the requirements (i also went through Tier 2 extension recently so know the process/requirements first hand).

However, i couldnt help thinking what happens if home office for whatever reason refuse the new application? would my existing leave to remain stay in tact? or would that mean i cant stay in the country becoz my exising one is also cancelled?

i havent resigned / mentioned the intention to my current employer so no reason for them to create any issue..

Gardening Leave - any impact on ILR

found the forum really useful so far. have another question regarding ILR (via Tier 2) so thought best to place in Tier 2 section.

I am looking to switch employers (Tier 2 to Tier 2) and hoping to apply for ILR soon after that in a year an a half. there is a chance that my current employer offer / place me on a gardening leave to serve the notice period. my question is would that cause an issue for the continuous job requirements for ILR?

cant see any problem.. you will still be paid so no impact.
make sure you dont end up leaving the country, thinking that you can apply for the new application froom your home country. You have to apply for visa tier 2 within uk.

Thanks I thought the same since it's just that I won't be turning up at work but the existing contract is active.

I am applying for Tier 2 next week so that should be fine.
