Tier-2 Dependent ILR

Post by Kaley » Sun Dec 13, 2015 1:40 pm

Hi

Tried to find relevant post, but unfortunately couldn't find the one I was looking for. Apologies if there is already one similar to mine.

My situation & question is;

1. Tier 2 main applicant entry clearance in April 2012 and now planning to apply ILR in April 2017.
2. Dependent entry clearance as Tier-2 dependent on September 2013.

What will happen to my dependent while I am applying for ILR;

1. Can she apply for ILR at same time as me in April 2017?
2.Or apply as Further leave to remain of PBS dependent on April 2017?
3. When can my dependent apply for ILR based on her above entry clearance information?

I am worried her ILR counting will be reset when I am apply for ILR.

Appreciate for your help.

Regards,

Kaley

1. Can she apply for ILR at same time as me in April 2017?
No, she needs 5 years residence to qualify for ILR.
2.Or apply as Further leave to remain of PBS dependent on April 2017?
Yes, so that she makes up 5 years residence.
3. When can my dependent apply for ILR based on her above entry clearance information?
No sooner than 28 days before the 5th anniversary of the date she ENTERED the UK as PBS Dependent.
I am worried her ILR counting will be reset when I am apply for ILR.
It will ONLY reset if she switches to FLR(M) once you are granted ILR. It WILL NOT reset if she extends her PBS Dependent visa.

ILR Dependent form

Post by Kaley » Mon Mar 27, 2017 1:27 pm

Dear Forum members and Gurus,

I am back again with some questions regarding my dependent application. I hope my question doesn't make boring to some of the forum users with same type of quesitons.

I am on Tier-2 and will apply ILR within few weeks time in same day service. I am planning to apply my dependent visa same time with me as priority service. However my dependent is not eligible for ILR ( less than 5 year in country as my dependent), so we are planning to apply my dependent on PBS migrant. Now my questions are;

1. Can my dependent apply for further leave to remain in same time as me when I am applying for ILR?
2. If we can, then which form to use for my dependent applicaion for further leave to remain without loosing her ILR counting. Is it FLR (M)? Or is it online application form PBS dependent?

2. In my application form SET(O) application form do I have to mention dependent is applying with me? Or I can only mention myself in this form as we are applying two different category.

I tried to use immigration lawer this time, but none of the one I contacted convinced me. I trust more in this forum, which has been very helpful in my previous application.

Once again appreciate for your response.

Regards,

Kaley

1. Can my dependent apply for further leave to remain in same time as me when I am applying for ILR?
Yes, but a separate appointment a couple of hours AFTER yours as they are applying in a different category.
2. If we can, then which form to use for my dependent applicaion for further leave to remain without loosing her ILR counting. Is it FLR (M)? Or is it online application form PBS dependent?
Tier 2 General dependent partner/child. Online form only. https://visas-immigration.service.gov.u ... nt-partner and https://visas-immigration.service.gov.u ... dant-child
2. In my application form SET(O) application form do I have to mention dependent is applying with me? Or I can only mention myself in this form as we are applying two different category.
No because they are not applying for ILR.
