Child born in UK to Australian Parents without ILR

Hi,

I was hoping for someone to clarify the process my wife and I need to go through in order for our Daughter (born in the UK) to obtain British Citizenship.

My wife and I are currently on UK Ancestry Visa's and we had our daughter earlier this year in the UK (May). We have since applied for Australian citizenship and Passport and have also applied for her Visa to be a dependent on our Ancestry Visa - no problems. We have also travelled to and from Australia - and she entered the UK on the Visa that was issued by the UK V&I.

What I wanted to understand is when we go to apply for ILR (Form SET (O)), in the 6 months while that's processed, can my daughter remain with us within the UK? We plan on applying 28 days before the end of the current Visa - and from what I can tell, we are allowed to stay in the country until we receive a decision. Once ILR is approved, then she automatically qualifies for British Citizenship (Form MN1).

If someone could confirm, that would be fantastic.

Yes, it will be fine.

Also, why don't you apply for your ILR in person for a same day decision, you can still apply 28 days before reaching 5 years residence.

I thought that's just a paperwork check and you still may have to wait up to 6 months? Even better news if we can get it quicker :)

You may be confusing that with the Settlement Checking Service. In-person applications are submitted at a Premium Service Centre (PSC) and appointment slots are released 42 days in advance.

Bear in mind that an in person appointment costs a bit more, £400 per person more, but if you work out £400 pp over 6 months of anxious waiting being in limbo and potential mislaid documents, it is well worth the expense.
