Paid IHS £500 but got extension for 2 years only!

Hello again

My friend's wife got the visa today for 2 year Spouse/Partner..

I helped him pay the IHS online which was £500 i.e. for 2.5 years.

Just wondered how long they usually give out the spouse extension visas..

I thought if they charge the IHS for 2.5 years so she should have got at least the 2.5 year extension..

Any comments

It should be 2.5 years.

Did she apply by post or in person?

What are the exact start and end dates of her new visa?

Entry Clearance received
Granted Start Date Sep 2013
Come to UK 5-11-2013
Visa End Date Jan 2016

Extension applied and now granted Biometric card
Visa start from 19-1-2016 to 18-1-2018
Spouse/Partner Leave to remains.

This the second time received less than 2.5 years visa.. I know even with 2.5 visa she still has to wait until 5-11-2018 to apply for ILR however why they didn't give minimum 2.5 on both occasions..

You will need to raise it with HO or the email address that came in the leaflet with the BRP card. It is an error.

I have paid £500 IHS which would indicate that I should have been given at least 2.5 year visa.

Please review my extension BRP that is just granted and I believe I should have been give at least 2.5 years

Apply for administrative review

You may request a reconsideration. Say that leave should have been granted for a period of 30 months under D-LTRP.1.1.

Can I ask, Did you apply for the IHS after submitting the online application or before. And if its before how long before we submit the actual application can we apply for the IHS.
Any amount of info will be gratefully accepted. As am in the process of applying for hubby to come over from Jamaica

You shouldn't really tag onto another member's thread. However, the NHS surcharge must be paid before submitting the application as you will have to include the IHS number which will be issued after payment.
(Casa, not CR001)

I have received my new BRP on 21st Jan 2016.

However I think you have made mistake with the length of stay I am granted i.e. from 19th Jan 2016 to 18th Jan 2018 (24 months only).

As per guidance Immigration Rules Appendix FM: family members (Family members) Rule D-LTRP.1.1, I should have been given 30 Months Leave to Remain. (see Appendix- A on page -2 )

Please review my extension decision and extend my visa from 24 months to 30 months.
APPENDIX

A- Section D-LTRP: Decision on application for limited leave to remain as a partner
D-LTRP.1.1. If the applicant meets the requirements in paragraph R-LTRP.1.1.(a) to (c) for limited leave to remain as a partner the applicant will be granted limited leave to remain for a period not exceeding 30 months, and subject to a condition of no recourse to public funds, and they will be eligible to apply for settlement after a continuous period of at least 60 months with such leave or in the UK with entry clearance as a partner under paragraph D-ECP1.1. (excluding in all cases any period of entry clearance or limited leave as a fiance(e) or proposed civil partner);


B- Section R-LTRP: Requirements for limited leave to remain as a partner
R-LTRP.1.1. The requirements to be met for limited leave to remain as a partner are-
1. (a) the applicant and their partner must be in the UK;
2. (b) the applicant must have made a valid application for limited or indefinite leave to remain as a partner; and either
3. (c)
1. (i) the applicant must not fall for refusal under Section S-LTR: Suitability leave to remain; and
2. (ii) the applicant meets all of the requirements of Section E-LTRP: Eligibility for leave to remain as a partner; or
