ILR Stepson/Settlement husband with exp date

Post by kjr1605 » Sun Feb 21, 2016 3:57 pm

Hello I have a question I am British, My step son (who I have raised since he was 2) and my Husband both have lived in the UK for 9 years, now my sons passport has an ILR stamp with no exp date but my Husband has ILR Visa but there is an expiration date of march of Next year? Will we have to apply all over again or will get a new visa automatically?

Now my Son (who is not mine biologically) is turning 18 next year and needs to get a new passport now will he just get his visa transferred?

Thanks

Is it a vignette in his passport or does he have a BRP card? If the latter, he needs to apply for a replacement BRP.

As your step-son has a vignette in his old passport, he needs to apply for an NTL. I believe that he will also be issued a BRP as ILR vignettes are being phased out.

Is your husband the sole carer for your step-son? If your husband naturalises before your step-son turns 18, your step-son could get registered as a British citizen along with your husband's naturalisation. Otherwise, he would have to qualify as an adult in his own right.

My Husband has the visa in his passport, is it a long process or is it pretty straight forward because they have both been granted ILR already? Or do we have to prove income etc etc again?

Yes we have been my step sons main carers sine he was 2 his birth Mom has nothing to do with him and basically signed her rights over when we applied for him to move here with us.

Thanks in advance

As they already have ILR, they will not need to gain it again. But in both cases, the form to fill in is the NTL form. I believe that both will need to submit biometrics and will be issued BRP cards.
