ILR for Tier 1 (G) dependent

Hi Everyone,

I am on Tier 1 (G) and would be eligible for ILR in April 2016, MY question is for my Spouse.
She came to the UK in 2007 as student and then moved to PSW in 2009 after that she got sponsorship in 2009 so switched to TIer 2.We got married in 2013 and from then onwards She has been my Dependent i.e Tier 1 (G) dependent.

My question is will she be eligible to apply for ILR at the same time as me or not?

No. To apply for ILR as Tier 1 G Dependent, she needs 5 years residence.

However, if she meets all the requirements, including absence limits, she can apply for ILR in 2017 on the basis of 10 years long residence.

Thanks for you reply, in which case what visa she would need to apply to continue to keep her 5 years route for ILR as her visa would be expiring in May 2016.

If you apply for ILR based on Tier 1 G, your spouse can continue to extend her current Tier 1 Dep visa.

Yes, but she needs a separate appointment. You cannot include her with your appointment (i.e. main plus dep). Her appointment can be booked for a couple of hours after yours.

She must use the Tier 1 Dependent application form, link below.
