Tier 2 General Advise Needed - Urgent

Hi All,

My employer just applied for a sponsorship licence and my visa expires on the 11th April. Can I apply for tier 2 general without COS number just to gain some time? I would attach a covering letter explaining my situation.

You can try but it wont work i think.

SOmeone tried it and a lawyer suggested for FLRO.

I would say clal their helpline and ask them frankly that can yo do it?

I would be extremely wary of relying on guidance given by the UKVI helpline. They are notorious for giving incorrect advice, even on simple immigration matters. Neither will they accept responsibility for their error.

You are request to extend your leave for other reasons(You are ready to be sponsored by someone who is awaiting a lisence)

I was once in a situation like this and a lawyer advised me about it but then the situation fixed itself so i didnt.

This is what lawyer said

"In worst case your FLRO will be rejected but they wont make decision before 2 months and you are borrowing time. If you are confident within 2 month sponsor will get lisence then launch one and when sponsor gets lisence withdraw FLRO before they even rejevt it"

Also 28 oday overday is allowed if you can be sponsored within it.

Unfortunatley in your case frustration is that your sponsor dont know when he needs lisence. I hope he has sent maximum documents which maximises his chance of getting it sooner rather than just sending mandatory documents.

FLR(O) applications which have no solid and valid reasons are refused very quickly. HO has become very aware of people using this application to 'buy time'.

A reason of 'waiting for sponsor license' is unfortunately not sufficient for FLR(O). The OP should have tried to resolve his visa/employer issue sooner.

Not sure if this is the OPs employer she was planning to switch to last year.

Hi,

Yes, it is the same employer, for some reason they could not do it sooner, hence we posted the application today. They are willing and the aplication is genuine. Will there be another route I can extend my stay if not FLRO?

Turn around time for a licence application will not be less than 4 weeks and that assumes the business does not get a pre licence visit.

Hi All,

I really need your help urgently.

I sent an FLRO application just before my visa expired, while i was still waiting for the sponsorship licence to come through. Once the second was approved and I got COS number I applied for Tier 2. For both applications I paid the Heath Surcharge and application fees. I recently found out that, my FLRO application health surcharge was refunded and yesterday my Tier 2 application fee was refunded in full. The FLRO application fee and my Tier 2 Health surcharge were not refunded. Has anyone had a similar issue? Would anyone know what this could mean?

Your help is much appreciated.

A refund of the immigration health surcharge is usually an indication of a refused application,

A refund of a complete application may intimate an invalid application that didn't get off the blocks. Not sure.
Or maybe because you varied to another application. But then why would the other's IHS be refunded(?).
Are you sure about which IHS was refunded?

Thank you for your reply.

Another problem is that I have submitted fingerprints of Tier 2, which I have received a refund for. I never had a biometrics invitation letter for the FLRO application, yet they refunded the health surcharge.

Has anyone had a similar situation before?
