ILR Application Based on Tier - 2 ICT

How can we apply for ILR here in UK based on the following details and Tier-2 ICT Visa :


Current visa Type : Tier 2 ICT
Date of Issue : 28-09-2011, Date of Entry : 05-10-2011
Initially valid till 05-10-2014
Extended till 15-09-2016

(All dates are in DD MM YYYY)


My understanding is that I can apply for ILR in the 28 days leading up to our 5 years residence period.
This is calculated from the date Visa would have been issued and not from date of entry, as long as I entered within 90 days of this original Visa being issued, I'm well within both dates.

Am I eligible to apply for ILR based on above information and how.

Tier 2 ICT issued on or after 6th April 2010 does not lead to ILR.

I think you can spend a maximum of 6 years on T2 ICT, otherwise you'll have to return home and find a T2 Gen. Sponsor, and wait the 12 month cooling-off period (I think) then start your 5 years from then.

-Can switch to a dependent visa if your spouse is also a main applicant

On gov.uk , apply to settle in UK,
Select Work visa and than Tier 2 ICT Visa

It shows 2 options to qualify :

To qualify, you must have had at least one of these visas in the 5 years:

1) Tier 2 (Intra-Company Transfer) issued under the Immigration Rules in place before 6 April 2010 - Certainly not applicable to me
2) Work Permit for an intra-company transfer - What is this category.

Work permit visa used to be issued prior to the points based Tier 2 visa. This visa is obsolete now

Is it 5 years or 6 Years.

Tier - 4 / Student Visa - can the partner work

Hi

Can I switch from TIer 2 ICT (Dependent, Issued Post April 2011) to student Visa ?

Does this switch also require cooling off period of 12 Months ?

Can I apply for Student Visa (Post Graduate course ) from within UK. ( Shifting from Tier 2 ICT Dependent to Student Visa / Tier 4 )

Is my partner allowed to work as my dependent (earlier on Tier 2 ICT, main applicant)

Any restriction on type of course I can join ?

Any restriction or type of work my partner can do or continue with existing Job, now as Tier4 (student Visa dependent, earlier tier 2 ICT main applicant)

What kind of funds do we need to show ?

Any other information pls.

Hi,

Cool off period is only applicable if I have to apply with the existing employer ? or is is still applicable if I change my Job / Employer and re-apply / re-enter with Tier 2 general.


The 12 month cool off period - where is this stated on UKBA / Visa & Immigration website, if someone could help with the relevant links pls.

What I understand from "Can switch to a dependent visa if your spouse is also a main applicant"

1) My spouse applies as main applicant and I as his dependent ? while still remaining in UK ?

2) While I'm in UK as "Dependent" does that count for the cool off period ?

3) Can I switch back to being main applicant after 1 year on dependent visa ?

1. Yes, you can switch to dependent within the UK.

2. Yes, you need the full 12 months on dependent status.

3. Yes, see #2. You will have to apply for for Tier 2 General from home country.

If your spouse is on a dependent visa it may not be possible for him/her to switch to Tier 2 General for instance in country. It would be a fresh entry clearance beware.
With only 2 months left on your leave, you will need to act fast mate.
