Student applying for a spouse visa

Post by willian » Wed Dec 07, 2016 1:23 pm

Hi,
Is there anyone in this forum who has applied (or knows someone who has applied) for a spouse visa (FLR(M)) while studying and being sponsored by a government or international scholarship agency. I'm currently in that situation and don't know if I stand a chance to get a further leave to remain with my British wife, whom I got married to a few months ago. Problem is, sponsored students are usually requested to obtain a consent letter from their sponsors when switching visa categories within the point based system (PBS). I don't know if this condition applies when seeking to remain with a partner/family. I'm quite worried because my chances of getting such letter from my sponsor are next to zero and my wife is pregnant. She needs me more than anything else right now. Your advice is welcome.

Does your wife meet the income requirements of £18600?

She may well be able to sponsor you in that case.

English Language test

Post by willian » Tue Aug 22, 2017 8:19 pm

Hello everyone,
I am preparing for my spouse visa application next month and was advised to have an English test instead of the NARIC compatibility statement. Please which English test is most appropriate for FLR(M). Our solicitor advised I do GESE Grade 5 (B1). The home office specifies level A1 but the solicitor said I can do the test at the B1 level and won't have to sit for another one when renewing my visa. Can someone advise me on this, please? :D :D :D

B1 is higher than A1 so yes, you can do B1.

It MUST be from a HO approved test provider and MUST be the IELTS SELT test. Costs about £150.

Did you say it must be IELTS? My solicitor recommended Trinity College GESE Grade 5 (B1 test).

It must be a test that is on the HO approved list. Most of them are now IELTS SELT. Check the list and see if what your solicitor is suggesting is on the list.

All good then.

Bear in mind that B1 is the current requirment for ILR. In 5 years time, anything could have changed so you will need to make sure you meet the requirements at each stage of your spouse visa journey.

Company's name changed

Post by willian » Fri Sep 08, 2017 6:44 pm

Hello everyone, I'm back again. I will be turning in my application by the end of the month and everything seems alright. I have a slight concern, however, my company was acquired by another firm early last year and now bears a new name. However, on the bank statement, one of my salaries was paid in the old company's name as the name change had possibly not been effected by the bank or whosoever was responsible for paying. How can I clarify this issue so that it's not picked upon by the ECO. Thanks in advance.

Its called TUPE transfer when old business is being taken over by new businessman who usually take over previous staff too. About that there is no guideline by HO so I think it will be treated like New employer where usually category B come into play if not being worked for at least 6 months for that employer.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

In this case, my spouse has worked with them for over 6 months. But the April salary was in the old name.

Sorry, my post seems a bit vague. Firstly, my spouse is the sponsor and her salary is the one in question. Secondly, she has payslips for 6 months all in the name of the current employer. However, looking at the bank statement for April 2017, the salary came in the name of XYZ (hypothetical) instead of ABC as shown for subsequent months. I'm hoping UKVI won't pick on this.
