Residence requirement question.

Post by jathampy » Sun Jan 08, 2017 9:57 pm

I got ILR (10 years long residency route) on 03-Aug-2016. I would like to apply for Naturalisation in September 2017. As per AN Guide, "To satisfy the residence requirement you should not have been absent for more than 90 days in the last 12 months. And the total number of days absence for the whole 5 year period should not exceed 450.".

I came to UK first time in Aug-2006.So if I apply naturalisation in Sep 2017, the 5 year period staring date comes in September 2012. That time I was not in UK. I left UK in 11-Aug 2012 and return back with new work permit visa in 13-Jan-2013. Will that satisfy residence requirement ? Do I need to be in UK for the starting date of the 5 year period?.

Correct. You must have been physically present in the UK at the start of the 5 year qualifying period. If you apply and you were not physically in the UK, your application will be refused.

What date exactly in Aug 2016 did you get ILR and what date exactly in Aug 2012 did you leave the UK?

Thanks for the quick response. I applied ILR in person on 27-Jul-2016 and the approval letter was received on same date. However the ILR BRP card is showing the issue date as 03-Aug-2016.
I left UK on 11-Aug-2012.

Suggest apply for citizenship on or after 3rd August if you want to apply this year.

Between 3rd and 12th August (both days inclusive). Applying via NCS recommended.
