Reconsideration application under EEA

Post by Michaelezinwa30 » Wed Jan 18, 2017 11:43 am

Hello,

Please I seriously need advice on what next I should do. My application to retain right of residency was refused based on the caseworker saying during the time of Divorce my wife was not excercising treaty rights. This reason was absolutely false because the evidence she was on employment was included in the application pack sent to the home office. My solicitor applied for a reconsideration based on the decision reached by the caseworker And the caseworker responded within 3 days that I have the right of appeal. My solicitor raised a complaint about her action and resent the reconsideration pack back to the reconsideration team in home office. since September and we have been sending letters for a response.
Recently I was suspended without pay because my employment checking service said I do not have right to work.
My solicitor is looking into appealing the case now...

Please I need advice on this issue and how I can get back to work?

If you submitted employment evidence for your sponsor perhaps it was not accepted for some reason.

What was wording of refusal letter (omitting personal details)?

The employment checking service said that my certificate of application was expired. My employer said they have to suspend Me.

My major worries is why the home office is not responding to the reconsideration. If they are not going to reconsider they should have sent back my application pack back to my solicitor so that we can appeal the case.
Am I not allowed to work knowing that the case is still pending?

If sponsor is a qualified person you can work.
There seems to be a question mark over sponsor's status.
What does refusal letter say?
