IED WITHOUT FLR; CAN MY WIFE SWITCH TO MARRIAGE VISA?

I would be very grateful for advice. My wife is an Indian Citizen, (I am British) she has been in the UK since May 2003 under the work permit arrangements. In 2005 my wife obtained a new job and her employer applied for and received approval from Work Permits (UK) for an Immigration Employment Document for 60 months. My wife did NOT apply for FLR. She thought that the Residence permit until 2008 that she already had was sufficient. We have just discovered this.

My question is this, could my wife 'switch' to a married visa; or would the authorities see that she is working here illegally?Please note we do not want to do this, it was a genuine mistake, we have a baby daughter and are desperate to sort this out. Please help if you can.
