WP to Tier1: Time line advise

Hai there

I have been in UK from Sept2006 on a WP valid till March 2009, now I am thinking to apply for Tier 1, I want to know

1) Can I apply for tier1 now or have to wait 1 month before WP expires (I understood from website this way, am I wrong?)?

2) 5 years on WP gives eligibility for ILR, but if I shift now my counter starts from zero again?

3) If you feel I can apply now, what do you suggest as the best time?

I have searched the forum for answers but could not find any concrete response, please advise me.

1. You can apply for Tier 1 anytime. No need to wait till your WP is due for renewal.
2. No. Read Immigration rule 245E here: http://www.ukba.homeoffice.gov.uk/polic ... es/part6a/
3. Check with an astrologer :wink:

On the BIA website, read the sentence preceding the one that gave you the impression that you should apply 1 month before your WP expires.

Hi,

Just want to know that, I am going to the UK on WP and then want to switch to TIER-1 immediately I reach UK (on WP as I said).
Is this possible. I already have the HSMP approval letter with me which I got here in India.

Please suggest.

Anyways, IMHO you will not be able to switch from WP to Tier 1 visa from within UK if you have been granted HSMP approval from India.

Suggest you check with BIA directly and get a definitive answer from them in writing.

hello Forum Members..

I am currently on WP in UK (for more than 18 months) and working for an Indian company. I am being Paid Indian Salary and UK allownaces. I am planing to change my status from WP to Tier 1. While filing my application, in prev earning, can I use uplift as my main earning is in India where I am paying taxes etc.?

Also is the success rate is more if you apply through an agent? As my case is not straight fwd so wud u suggest me to go through agent? HO has already increase the fees to £750 so very expensive to take risk, in case my application gets rejected.

Has any of the member has applied from Uk based on Indian Salary (with uplift)

I really appreciate any response.

Hi Coolwp,

Since you were in UK since last 18 months , you cannot uplift your Indian Salary . PLease read through the guidance note for Tier 1 in detail .

Agent can help but will not increase your chances ... as it is another 700 or so to get an agent apart from HO fees .
