plz help me on my EEA 2 PROBLEM

Hi guys,

I came unlawfully into the UK 7 years ago which am not proud of knowing what I know now.

I now have a Bsc degree in science and a 4 years old child and been with my partner for 5 years but still depend on my aunt who is an European citizen that lives and works in the UK

My question is can I apply for an EU/EEA Dependant permit?

If you live with your partner, in what sense are you still dependent upon your aunt?

Also, your partner, are they British, or EEA, or if not what is their UK immigration status? And if you are living with your partner, can you prove that the two of you have lived together for at least the last two years?

Finally, what is your nationality?

Thanks for you interest in my situation.

My aunt is a French citizen and my partner is British. Am dependent on my aunt because have not work for over 2.5 years.

How can I prove myself and my partner lives together?

Turning this back on you, how will you prove it? Do you both have post posted to each of you at the same address? Indeed, do the two of you actually live together?

Your aunt, OK you have not worked for over two years, but aren't you supported by your partner?

No, i don't receive post at my partner's address. I spend some time with my partner,my aunt and friends.

My partner do support me but my aunt is on higher income and welling to help.

I try as much as possible not to be a burden on my partner cos its sometime put strain on our relationship.

What a shame. I was going to suggest that you applied for an Unmarried Partner Visa, but with no proof of you living with your partner, that would prove a wasted exercise.

Is there any prospect of you and your partner getting married?

yea my partner actually suggested we should get married but I though the EEA2 is a better option. What do you think?

I think you would struggle with an EEA2 application. Another blunt question ..... what proof do you have that your aunt is supporting you? Are you really her dependant?

If marriage is a possibility, go back to Nigeria, the two of you get married there, and then apply for a spouse visa to enable your return. Not only that, do ensure that you leave the UK prior to 01.10.08, because if you leave afterwards there will be an automatic ban on you returning for years, giving your current breach of immigration rules.

Staying in the UK and doing nothing is not an option. You need to leave by end September, at the latest. Submitting an EEA2 application? Highly unlikely you would hear the result of that before October, and if it is rejected you have a real problem.
