Information for spousal visa

Hi,

I wanted some information regarding spouse visas. I applied for my husbands visa last august. It was refused in March 2018 due to payslips not being genuine etc. My solicitor adviced me to get employment history letters showing that tax and everything is being paid and I did exactly that. So we sent of the appeal. The appeal was lodged onto their system in June 2018. I have now received my appeal hearing date which is in April 2019. I was wondering if the date for the hearing can be brought forward by any chance? As this entire procedure is taking ages now. I would like to know what sort of questions will I be asked? What documents I will need to take with me? How long the hearing will be? How many people will be in the hearing with me? What will I need to put in a statement etc? Just general questions. Id be grateful if someone can answer these questions for me please.

What was the actual wording for your refusal, if you can post the grounds of refusal here, taking out personal data, we can have a look?

Without knowing the actual grounds, it will be hard to guess what you need to fix for the appeal. Why did they think your payslip was non-genuine?

It says on the refusual letter, that one of the jobs shown (its payslips dont look genuine) and that the tax year, doesn’t show that I continued the employment so the financial requirements arent enough. So my Solicitor adviced me to get employment history letters from HMRC showing that the tax is being paid and I am currently still there.

You should copy paste the original wordings of refusal by deleting personal information.

If you have a solicitor representing you, then best place to ask all these question is to the solicitor as they would know best about your case.

When asked to state the grounds of refusal, OP replied back with it's ok solicitor dealing with it. Not sure what more input to give.

Does anyone know if there is a contact number for the home office where they review cases? As for what my problem is that, my case hasnt been reviewed yet. I was told theyve been given 15 weeks to give an answer and we are now on 23 weeks. Is there a number or something I can call?

Dear Colleagues,

We have received confirmation from the visa application centre that the above named applicant has submitted their passport following an allowed/withdrawn appeal. Proviso records indicate that the applicant's passport has expired. If the applicant has provided the expired passport they need to be notified and have the passport returned. They will need to submit a new passport to allow us to proceed with the appeal.

Once a new passport has been received, we require checks to be carried out before we can implement the decision.

Please send a scan of the bio data page from the new passport to Sheffield.AppealDeterminations@fco.gov.uk.

In addition we also require an ECO or above (or an IEI colleague) at your location to undertake checks on the new passport to confirm it is genuine. Please confirm that the checks have been conducted by emailing
Sheffield.AppealDeterminations@fco.gov.uk.

I think your passport is expired and they won't issue visa on it. They expecting renewed passport for issuing visa.

There is a new passport submitted with the expired one. I just dont think theyve seen both. So I’m not sure what to do now? At the visa application centre they didnt say anything..

I would like some information on how long it takes for a passport to be stamped for the Visa? The passport was submitted on the 3rd of June. I wanted to findout how long it takes. If anyone can please tell me I'd be grateful. This is all getting so long to wait for as this visa case has been going on for over a year and a half now.

It can take between 1 week and over 2 months. It depends on how lucky you are. I’m one of the unlucky ones, as I submitted my passport on the 29th of April (8 weeks ago) and still waiting to get it back. But to be fair to the HO, they just sent the link for IHS payment 2 weeks ago (which I paid straightaway).

Have you made the IHS payment?

IHS payment was made nearly a month ago. Passport was submitted over 3 weeks ago. Now Im just impatiently waiting as this case is taking forever now.

My case went to an Appeal. After the case went court, the visa was allowed by the judge. I just wanted to findout if the new TB test needs to be sent with the passport? And how long it takes for the passport to come back?

No need if any new test despite the old one has now been expired because it must have been unexpired at the time of application which only better. You could have only needed the new test if you re-applying.

Okay, so the TB test result doesnt need to be sent off? I do know that they only look at the TB test at the airport right? As it is a medical test. Would you know how long it will take for the passport to come back? The passport was submitted over 3 weeks ago. Thankyou so much for responding.
