Separation/FLR (FP) Parent 10 Year Route

Post by Tezuka45 » Thu Jan 24, 2019 12:46 pm

Apologies if this is not posted correctly; I couldn't locate a suitable entry point elsewhere.

Situation:

My non-EEA wife and I are now separated. She has leave to remain on a spouse visa, residing in the UK since 2008.

In 2018 I informed the Home Office that we had separated, following their guidelines. As indicated in those guidelines, we were expecting the HO to write to my wife. They have not. In fact, we have no way of knowing if they even received the letter -- unfortunately it was sent by Thai post so it may have never arrived!

My wife would be eligible for her own visa now as parent, on the 10 year route. The issue I'm raising here is how should we proceed at this point? -- Should a visa app be made now? OR should I write again to the Home Office? ---- Finally, is there any way of checking whether the HO received the letter and therefore know we are separated? ---- It seems unlikely they do know as it is indicated in guidelines that the spouse visa is invalidated upon separation or divorce.

Any info/answers to the questions raised above would be very sincerely appreciated.

Very best wishes,
David

Why does she not apply for ILR based on 10 years long residence if she has been in the UK since 2008 legally (presumably)??

Thank you for your reply.

I'm sorry, but I wasn't aware of '10 years based on long residence' visa.

I'll research that, or do you have a link at all?

Thank you again for your suggestion.

The only concern with this visa is there is scant info on which supporting docs may be required e.g. birth cert, marriage cert etc. etc.

The webpage states: "You may need to provide additional documents depending on your circumstances."

I don't suppose anyone has any experience of this visa route at all? All info greatly appreciated!!

Best wishes,
David

Many have 'experience of this route' and many apply on this route due to the limited documents required.

See the guidance notes in the link below.
