Absence exceeds 90 days in the last 12 months

Post by julitabrz » Tue Feb 12, 2019 6:51 pm

Hello,
I am in the middle of my citizenship application however, just calculated my days outside of UK and in the last 12 months it was 114.
It is a bit too much unfortunately. on fiirst journey O stayed around 3 months as i organised my son christening and later my weeding. The second one was unplanned. My all docs were becoming invalid after surname change and had to flew back home to apply for new docs and waited once they were ready for the collection.
Does anyone think this is can be taken in consideration as a good proof by HO to disregard this absance?
One more question, what exactly means" established home and a substantial part of
your estate"? I have family here, job but I only rent a flat and do not own any property. Does it mean that I would need to have my own property?
Thanks

Easiest would be to wait some time until the year's absences preceeding the application date have fallen to 100 which is normally disregarded.
This is just my opinion as a member of this forum and does not constitute immigration advice.

Do remember that you would be calculating absences in the 365 days prior to your date of submission. As replied by alterhase, maybe delay it by 2-3 weeks and you will be in the clear (unless there are absences at the beginning of the 365 day period). Plus don't forget - you must have been in the country on the same date as your application, 5 years ago - in case you delay your application to meet number of days.

Family, job, bank balances, maybe a private pension and if possible, rental contract - all these are sufficient proof of establishing home and sufficient part of your estate in the UK.

Thank you. Unfortunately I would have to wait till end of July. All other requirements are met. So rental contract should be enough, bank balances, pension and job contract? No requirement for owning a property?

100 days absence last year

Post by julitabrz » Mon Feb 18, 2019 3:48 pm

Hi,

I want to apply for British Citizenship and had 100 days exactly outside of UK last year. Do I have to ask for discretion or it should be disregarded.
Also would like to ask one more question.
One of the requirements is to intend to live in the UK. Of course I do not have plans to move out to any other country, however life is full of surprises so what would happen if I move somewhere else in about few years?
Do I have to contact HO then and provide such info that I am leaving UK, what are the consequences?
Thank you

No, HO usually disregard absence in the final 12 months up to 100/110 days.

No. Once you are British you are free to leave the UK if you wish to.

No, property ownership as you may have noted, has become a luxury in the UK.

Bank statements - I submitted last 12 months, to show that it was going to a UK address (as you would do if you are only out of the country temporarily) and that I didn't change it to elsewhere outside the UK. Again, there is no minimum balance requirements
