From date of marriage -
Date of marriage to my EU spouse 05/10/2014 so I will be eligible for settled status on the 05/10/2019, hope this makes sense

Hi Mate,
Am in the same situation as you are. Married in 2014. Am on Right to retain. Applied on 21/1/2019.I have called them lots of time but no answer. Yesterday I got a call from the Home Office and asked me the same question as being eligible for settle staus in June and I asked him I am happy to get pe settle status.
I called them today as well and they said the call was not from caseworker its from resolution center and they will escalate my case.
I think you should call them just to get an update.

Hi buddy, even I called them so many times. Couple of days ago I requested to escalate my concern to the senior manager and that’s why one of the case workers called me. Today they have replied to my complaint which I made few days ago and confirmed that one of the case workers called me. Even case worker confirmed about him. Today I have submitted another form requesting to send me confirmation of pre settled status. Case worker asked me the same question wheather I am happy or not with the pre settled status. This is kind of annoying as it being taking so long, everytime I contacted them they gave the same silly excuse that cases all assessed on the case by case basis like they do traditionally m.

Yeah, its really annoying situation whenever you call them they give the same reply as they have already set their answer.
How you made a complaint. Like do I need to call them.
Please update when you receive an email from them or your decision hope they will send soon.

I will certainly update you, you can fill the online form,which goes to EU resolution team and you need to state in the information section that you would like to make a ‘formal complaint’ to the senior management as EU settlement scheme aims to process all the applications within days or maximum of 2 weeks where they require more information. EU resolution team should act to help all the applicants and also take appropriate steps to deal with their concerns.

3 applicants: EU with PR, EU child, Non-EU spouse (6.5 continuous residence in UK, last 2 years on EEA RC)

Application submitted: 11/3/2019 (all)
Soft decision: Settled status (suggested for all)
COA received: 11/3/2019 (all)
Application decision (EU with PR, EU child): Settled status granted on 14/3/2019
Application decision (Non-EU family member): No update yet

I understand there are a few of us is a similar situation (i.e. non-eu waiting for a decision whilst their EU family members have received a decision in a timely fashion). I was wondering if someone can advise on what should be considered as the start date of the continuous period with regards to the settled status application. I see 5 potential options:

a) Arrival date in UK (2012)
b) Start date of ‘durable’ relationship with EU national (2013)
c) Date on marriage certificate (2015)
d) EEA RC application date (2016)
e) EEA RC approval date (2017 – yes it took almost 6 months to process)

For EU National - starting day will be the day when they entered in the uk

For non Eu national - Day when he married to EU national in the uk but if they married outside of uk then the day when he entered or hounded in the uk with their spouse

Extended family member -from first day in the the uk on residency card as a extended family member

Yes you can certainly apply under this scheme if you have a valid bomatric card on the basis of retain rights if you don’t have a card you have to wait until the scheme opens fully. I have a retain rights and applied for pre settled status

Im also on the same boat.have applied on 15/02/2019 and was given settled status offer..im also being issued with a retained rights of residence card before and my family life starting from marriage is more than 5 yeras now..but still waiting for the outcome and called once and email twice but the same answers was given.very much of worried about us as cant see much successful or any kind of news from those being issued with retained rights of residence with out PR.

All things being equal , one qualifies for settled status upon attainment of 5 complete years from date of marriage (if marriage occurred in the UK).

I would kindly suggest however though that based on your application history as highlighted above , It might also be worth addressing the reasons for your previous refusal as that would also determine what category you fit in at the moment.

Ok. My first 3 applications for PR was refused due to not including my ex id. When i finaly get in touch with her and she clearly put in writing that she will not give the id cos we are dovorced. I printed all our conversation and sent to HO with my 4th applicatio. To my suprise the refusal letter i got was that they(HO) is not sure i have ROR. The ROR was the stamp on my passport which i submitted also.

So with the scenery is it advisable to go for Settlement?

Hi Mate, you don’t need to submit proof for your ex wife as this has already been sent when you were issued residency card, and if should have received a letter from HO confirming retain rights of residency along with your residency stamp.

1. When did you marry ?

2. When was the residency card issued on the basis of marriage?

3. Divorce date ?

4. When were you issued retain rights of residency ?

5. You were refused 4 times ? What they said in the 4 refusal letters ?

One thing sure, if you were granted residency card in the past or COA , or retain rights of residency you don’t need to submit her your ex wife’s ID as this has already been sent to them by you at the time of first residency card otherwise they wouldn’t have issued you card at first place, then after they issued retain rights so you do not need to submit your ex wife’s ID , they should check on the system. Certainly if you were issued retain rights you should apply for settled status. Settled status makes life easier as you don’t need to show payslips etc for yourself and your ex wife
