T1 (Ent) - T2 (Gen) - ILR: Some Questions

With the help of this forum, I've been able to successfully apply for my Tier Entrepreneur Visa and have since switched to Tier 2 General. I've found the information on here really helpful and never really felt the need to ask a question until now. I intend to apply for my ILR in the next couple of days and with a £6k fee (myself and 1 dependant, premium) I really don't want to get anything wrong, so would love to clear some doubts. Apologies if my queries have been answered lots of times, but here goes.

- Firstly, my annual salary is short of the £35.5K threshold by £600. However, I have a lease car which the company values it costs them over 3K per annum, and as I enjoy this benefit, the company has included it as part of my allowance on the employer's letter. I also receive some other allowance in excess of £1K per annum which is also included in the employer letter. Note that my payslip shows the £34+ K figure but monthly, the allowance reflects. Would this be an issue?

- Secondly, I had in September last year, been promoted to my current position but I haven't informed UKVI. Would this be an issue? It's still within the same SOC as my certificate of sponsorship.

- Thirdly, with regards to my 3 years under T1 (Ent), what evidence do I need to supply to prove that I met the conditions of the visa as at then? Would it be company returns? If so, would it be for all the years I've been trading or just the last year before I switched to Tier 2

- Fourthly, as I've travelled out of the country whilst on T1 (Ent), my understanding is that I don't need any letter or evidence to cover that period. Is that right? I was only away for 10 days

- Fifthly, my payslip is only available online and my intention was to print this out and present it as evidence. Would this suffice, or would I need a cover letter from my employer?

- Lastly, as my bank statements are now online, would it be ok to print out the pdf bank statements or would this require a stamp from the bank?

Oh BTW, I was hoping to apply for my ILR before they increased the fees. I just noticed that the premium service fees just shot up by another £190pp :evil:. I am so so so peeved right now.

Please, I need help understanding salary threshold and allowances. My current role earns me £34,800 and that's what's stated on my contract. On the same contract, however, it states I'm eligible for a lease car. I've now checked and it is costing the organisation upwards of £3,000 to provide with the car. This figure is however not included in the salary figure above. Considering I pay car benefit tax to HMRC, my employer has mentioned this £3k in the letter I intend to submit along with my application. The sum of the £3k and £34.8K will obviously take me above the threshold. Would you reckon this will be acceptable?

We will consider:
• guaranteed gross basic pay (excluding overtime); and
• allowances, up to the limit below, which are guaranteed to be paid for the duration of
your employment in the UK, and would either be paid to a settled worker in similar
circumstances, or are paid as a mobility premium or to cover the additional cost of
living in the UK.

I thought I should update my post above if it's of any help to anyone as I was successful in my application, despite the uncertainties I raised above. I must thank this post: indefinite-leave-to-remain/benefit-in-k ... 00952.html
  • I was able to use my company-provided lease car as part of my income. I used the benefit in kind (BIK) figure to bump my pay past the 35k threshold for this year. I was able to evidence this using the previous year's P11D form and supplemented it with HMRC letter stating my tax code for the current year, which also listed the BIK figure.
  • In the application form, I entered my total income, including the BIK figure. I then explained this on the employer letter
  • I'm not sure why but when I made my payment and was trying to book an appointment for biometric enrolment, I couldn't find a slot when using the Sopra Steria's mobile site. On day 4 of constantly trying, I logged in using the PC website and got a slot for a month away in Manchester
  • For the Manchester centre, I noticed that, as it is in the central library, you are able to take family members along, even if they are not part of the application. I noticed there was a member of Sopra Steria staff keeping an eye on children whose parents were going through the biometric process
  • Also, for some reason, they were not interested in the originals of my support documents, even though I made copies of them as advised somewhere on this site. So long as they were scanned and uploaded, they were happy. They were only interested in my passport and BRP card
  • My application timeline: Paid on 23/04/19. Managed to find an appointment on 26/04/19 for 23/05/19 in Manchester. Received approval letter on 22/06/19

Thanks for the clarity NINJA as i am in the same shoes at the moment .My extension of TIER 2 is next year and i have company car as benefit in kind (BIK) on which i pay tax but it doesn't reflect on my salary slip also i have been given this benefit few months ago so my previous year P11d doest includes this.
Which letter should i request HMRC to confirm this (the letter you attached with your visa application)?

It would be great if you provide me the sample of employer letter which mentioned the BIK value.

I am also little bit confused about the value of BIK . Currently my company car BIK value which is calculated by HMRC formulating CO2 emission is 7550 on which i pay tax. But my employer pay 460 pounds / month to lease company + costs to maintain the car .

Please can you confirm which amount should i use as a part of salary threshold of TIER2.
