Hi ,

No I did not pay back yet , but I can do, as I was not knowing any getting working tax credit will be problem, just realised now when looking at form, is ok if I ring hmrc and tel them I want to pay back ,?

Assuming this is a few years ago, I strongly suggest you resolve this before applying for ILR, if HMRC is able to do something so you can pay this back.

Hi cr001,

I did phone hmrc tax credit department, and asked them to pay bac all the money that I got , but they said they cant do that , I mean I can’t pay as there is nothing due or but they said they will write a not that I have offered to pay ,

Also in form it asks are you claiming , but I am not claiming I had in past , do I still need to tick , yes or , I am confused,

ILR : teir 1 entrepreneur: employee query

Hi again,

I am in teir 1 entrepreneur , due for ilr next year , I have got two employees and if one of the employe leaves and I hire new for same job , will my one year continues employment counts for that employee, I am due ilr in mid April 2019.

You need 12 months of job creation - it does not have to be the same employee nor does it have to be continuous.

Hi marcnath and all,

I have got a question on depends ilr .

Me and wife are been on program for 5 years but our daughter joined after 2 years so she has not completed 5 years, what the best to with Visa while we apply for our ilr, also she still got valid leave till March 2020, so do us as well but we applying as it's best time as finished 5 years, my friend told me I can apply her British citizenship straight away once we get our ilr , is that true?

Please help

There is no minimum 5 years residence for children. She can apply for ILR when you and your spouse apply.

Your friend is confused and no it is not totally true. Only UK born children have an entitlement to register (without ILR) as British once either parent gets ILR.

Children born abroad are expected to hold ILR and can only apply for citizenship once they have ILR and when either parent is also applying for citizenship or is already British and the other parent also holds ILR.

If your daughter was born in the UK, she can apply for citizenship once you get ILR.

Otherwise you need to apply ILR for her with you (there is no 5 year requirement for children) and apply for citizenship 1 year later.

Just wanted ask again, how many years or employment needed after extension of teir 1 entrepreneur, I have two employees worked for full time since I have got extension and it's more than 12 months, is that enough or I need to go back more or just send last 12 months payroll , and do we definitely need fps ,p32, p45, and p60 and all with pay slips, as well .

You need 2 FT JOBS (not employees) that existed 12 months each after extension

or

if your extension is granted less than 12 months from the date of ILR application you can claim for 12 months immediately before the ILR application date (2 FT jobs in these 12 months)


RTI- FPS, employee passport/settled status copy, payslips thats it.

Got my teir 1 Visa first on 17 may 2014,

Applied extension after three years in 2017,
Waited till approval till 2018 got it on 2/3/18 ,

5years finishing in may 2019 , so is one year of employment for two jobs from the month I got extension means 2/3/18 till 30 /4/19 is enough?

Yes you can claim from 2/3/18. Your 2 FT jobs complete 12 months on 1/3/19 given each job did minimum of 30 hours/week. You actually have 2 extra months till 30th April 2019.

I have got question, please help,

I have got my extension approval in March 18 but I moved to new house in July 17 , but I had all post redirected to new address , now question is what dates should I write on form as I have only redirected not change on application that time,

Please share thought and help
