Director of a dormant company

Post by feri_2017 » Thu May 09, 2019 12:00 am

A few years ago I registered a company, it has never been trading and has been registered as dormant. So basically its just a name.
was wondering if I need to mention it in my application?
I didn't mention it in the online form but I can write about it in my cover letter if necessary!

I'd appreciate any advice!

I think not necessary to mention.

The question is of employment. As the company never traded, it didn't employ you and didn't pay you either.

Strictly speaking the company has to set up PAYE to formally employ its directors, Without that the directors and secretary would be performing duties but arguably, they are not employment but part of the business. They could be consultancy agreements (whether written or not), but that's not employment.

Personally I declared as employment the time while my company was employing me and not the times it was not trading and not employing me.

Employment means being on the payroll not becoming a director.

Thank you both

I do understand the meaning of employment however what is confusing for me is the legal part of setting up a company. At the time I was student when I registered the company. (sorry should have mentioned it) So wanted to know if that has any sort of affect on my application legally or from the immigration law point of view.

Thanks again

Tier 4 guidance prevents business activity and trading. Dormant company should not be an issue

Correct.
I just read that. The registration of company was just for the purpose of reserving the name and the company was never used to benefit anyone and has never been trading.
