EEA FAMILY PERMIT DOUBTS

Post by dajudogho » Sun May 05, 2019 3:24 am

Hello Everyone,

I am a Nigerian with a 7 year old daughter and just got married in April 2019 to an EU citizen resident in the UK. I met my husband in December 2018,got engaged same month and he came over to Nigeria for both our registry and traditional ceremony.

I wish to apply for an EEA family permit this May;we have our required documents stipulated on the UKwebsite to back up the application but my questions/doubts are as follows:

1.Apart from the online EEA family permit form I am to fill for both I and my daughter, are there extra forms like the VAF5 form that my husband is to fill alongside against my application?

2. Are I and my daughter to pay for the IHS health surcharge before going to the embassy for submission or it is to be paid for after we are given the permit?

3. Will a notarized consent letter from her biological father who is studying in the US plus his ID cards be enough to back up my daughter's application?

4. Though EU citizens do not have financial and accommodation requirements, my husband annual income is £16000 and he just secured a 2bedroom bungalow this May also to prepare against our coming over. Do we stand a chance?

Hi Dajudogho.
1. Just the FP for you and your daughter.
2. No.
3. Not sure if this is mandatory, but it would be highly advisable to do so. Don't forget her birth certificate, to show that he is the biological father. Hague apostille is not mandatory, but advisable in both birth and marriage certificates.
4. Since his income is rather low, I wouldn't even mention the topic. In the new Family Permit form at gov.uk site, is not even a mandatory question as it used to be. I would definitely mention the accommodation part.

Let me tell you that the biggest challenge on your application is going to be avoiding the impression of sham marriage, since the timescale of your relationship is very short. You are going to have to disclose every detail of your relationship and back it with proofs. Pictures, emails, letters, social media (with links for them to access if possible), air tickets. Pictures with friends, extended family, from the day of your wedding, are powerful proof. If you show just pictures of the two/three of you posing alone, it will not work. Describe your relationship chronologically very thoroughly, and link events to supporting documents, so everything makes sense.

Wish you the best!

Regards,
Joaquin

Hello,
I am about to submit my application now but I need your advice on accomodation . My husband's company is willing to support my application by giving us a two bedroom flat starting in June 2019. The rooms are located upstairs in the shop my husband manages for the company. The company is giving it to us free and have also promised to pay all utilities for the period of six months. My doubts -

1. If the company writes that they have taken responsibility for our accomodation and utilities, will it boost my application or present as been too dependent on the company?

2. Should we at least get a utility in the house to read in my husband's name to prove he stays there?

3. If the company writes, can you please advice what documents they will need to provide to support my application.

Thank you very much for your timely response.
