British citizenship - EU family - kids born outside UK

Post by mrjohnsmith » Mon Jul 08, 2019 11:35 pm

I have searched for a specific topic re this matter but i could't find any: pls see below, i have a few questions:
Eu family, all EEA PR
All kids born in EU, all <<18 years old and all have spend more than 5 years in the UK (EEA PR rights)

Q1 It seems that i can use the online form for the whole family ("In your application, you can also include family members"). can someone confirm that the online form can be used for a family? or does this require multiple login?

Q2 Then reading elsewhere on this very comprehensive website, the UKVCAS process, it seems that i will have to upload documents to UKVCAS. Again, can I just upload all documents for the whole family with one login?

Q3 I have read MN1 and AN1, this application doesn't seem to require the translate birth certificate? how do they make the link between kids and parents? with the EU passport?

Q4 I also read that the naturalisation for the kids is done at home office discretion (not born in UK, less than 18 years old, page 13 of MN1 guide). Does anyone has experience of this? in that instance, is the fee refunded?? with this issue in mind, is it more suitable first for both parents to seek naturalisation and then apply for the kids?

Q5 Assuming a successful outcome for the naturalisation of the kids under Q4, can they then apply to get a british passport or are they required to wait to become 18 years old?

Many thanks

Adult EU citizens need DCPR or ILR (including settled status) before applying for naturalization. For kids born outside UK, it's not clear if PR is sufficient or a document is required. There seems to have been successes and refusals. Note that kids usually don't get PR by themselves as this requires exercising treaty rights not just residence, so dependency is required.

Personally, I suggest applying for settled status if the kids don't have DCPR or ILR. It requires just residence documents, a couple of school letters will do to cover 5 years. It is relatively quick too.

Q1: 1 login.

Q2: 1 login, 1 appointment. In fact kids can't attend by themselves. An adult is required even if not applying.

Q3: Birth certificate establishes link. There are extra documents in case of divorce and lost contact with other parent. Not sure about translation. I suggest searching the forum or raising the question again in this thread.

Q4: yes, discretionary, but so is for adults. There are clear rules, however, that case workers follow unless the home secretary intervenes. There is discretion too.

One tactic some practise is for one parent to apply (one fee), then for the rest of the family. Kids' applications can be considered even if parent's fails. If one parent is British and the other is settled, then kids qualify.

I personally applied for the whole family at once. There are many reports here that HO asks for extra documents if there are problems. No guarantee about that, of course.

Q5: once British, even kids can get a passport. If applying together with parents, they will get the registration certificate at the parents' ceremony. Otherwise, they get it in the post.

I just realized that when you say all have PR, you probably mean DCPR (applied and documented). If this is the case, no need for extra applications or documents.

EU PR is automatic, otherwise.
