Spouse Visa FMR (M) Extension - Financial Document - Company Less than a Year

Hi all
Thanks for providing comments over the years on various questions. Its been really a helpful community.

My wife came in UK Dec 2008. She is always been a dependent while I was in Tier 4, Tier 2. She is currently on FLR (M) from Feb 2017 when I was granted ILR and eventually I became British Citizen. She is been in UK over 10 years but couldn't apply for ILR due to the fact she was out of country twice over 6 months and total time spent outside UK exceeds just over 18 Months. She would need to extend her FLR (M) visa in Sep 2019. We have two child - a 6 year and a 1 year, both born in UK and are British. She has recently passed B1 exam. She is currently on Maternity leave and wouldn't use her income to full fill FLR (M) financial requirements.

I have always worked full time before but recently from Feb 2019, I have set up a limited company as sole director and self employed working as IT Contractor. I have dedicated accountant and I also take director's salary every month which is around £720/ month. The Gross income from Feb 2019 or April 2019 till 31st July is over £18600. My accountant will fill a self employment tax return for 2018-2019 which would include income from previous perm salary and 2 months self employment till April 2019. For tax purposes, I have also requested my accountant to do the year end till 31st July so that I can pay any TAX that is due. I also pay VAT and its been already paid for the first Quarter of 2019.

Based on this fact:
What would I need to tick in Financial options in her FLR (M) extension application and what documents would need to be submitted. I have read that UKVI request documents for last full financial year but I have started the company in Feb 2019 and its not been a full year yet. Would be really appreciated if someone could guide me and provide a list of financial documents required so that I can ask my accountant to get this for me. Also, it would be beneficial if a full list of documents that would need to be submitted can also be provided.

Your self employment might not meet the financial requirement but if your wife was earning at least £18600 while being employed with present employer from at least 6 months before maternity leave then it alone may meet the financial requirement.

Wife worked only part time so it wouldn't meet the threshold with only her salary.

Anyone please provide your views

If either/both of you have 6 months old cash savings of at least £62500 then it alone can meet the requirement too.

Sorry no such savings for 6 months.

Are you saying submitting the documents from the start of business date till end of Aug wouldn't be good enough even though the gross profit in this time frame exceeds the required threshold?

If you can't meet the financial requirement then she will have to apply FLR(FP) 10 year partner route.

9.1. Category F: Last full financial year
9.1.1. Where the applicant’s partner (and/or the applicant if they are in the UK with permission to
work) is in self-employment, or is either the director or employee (or both) of a specified
limited company in the UK, at the date of application, they can use income from the last
full financial year to meet the financial requirement.

9.4.1. Appendix FM-SE specifies further requirements for combining income under Category F
or Category G with other sources of income:
13(e) Where the person is self-employed, their gross annual income will be the total of
their gross income from their self-employment (and that of their partner if that person is
in the UK with permission to work), from any salaried or non-salaried employment they
have had or their partner has had (if their partner is in the UK with permission to work),
from specified non-employment income received by them or their partner, and from
income from a UK or foreign State pension or a private pension received by them or
their partner, in the last full financial year or as an average of the last two full financial
years. The requirements of this Appendix for specified evidence relating to these forms
of income shall apply as if references to the date of application were references to the
end of the relevant financial year(s). The relevant financial year(s) cannot be combined
with any financial years(s) to which paragraph 9 applies and vice versa.


As I have set my company in Feb 2019, my self assessment for the full tax year from April 2018 to April 2019 would involve income from permanent role and income from my limited company which would be way over the threshold - would this full fill the requirements?
