Applying for Spouse Visa with 6 months employment in two different jobs.

Hi there,

Hoping someone can provide advice.

Me and my wife were living in Shanghai previously and I have returned to the UK in March to start the 6 month working process to apply for her spouse visa.

I worked for a company from March until the end of May for 3 months. I then changed companies but in the same position and the same salary and in August will have been employed for 6 months, however under 2 different employers. Prior to living in the UK I had not worked in Shanghai for 3 months before my return.

Will I be eligible to apply for her visa or will I need to wait until I have been with my current employer for 6 months? One solicitor I have spoken too said this should not be a problem as it’s the same job, same salary and there was no period of unemployment. Any help would be greatly appreciated.

Was he really a solicitor :shock:

If you are not working for your employer from at least 6 months then you will have to apply under category B where you need to supply 12 months of payslips and bank statements. And if you haven't earned at least £18600 during the last 12 months then you can't meet the requirement.

Thanks for your reply. So let’s say I only have 6 months of payslips, 3 from employer A and 3 from employer B, if I apply for category B I have to have earned £18600 from those 6 months of employment to qualify under category B?

You must have earned £18600 during the last 12 months and secondly must have an annual income of £18600 or have earned at least £9300 during the last 6 months through all jobs. Alternatively if you have 6 months savings of at least £62500 then it alone can meet the financial requirement.

So in the last 12 months I have only worked for 6 months. 3 months at one employer and then I left for a. Better company. In those 6 months I have roughly earned about £14000 as salaried income.

Is there any route we could apply for now it will I have to wait until I have been in my current position for a minimum of 6 months?
