EEA Family Permit Denied - EEA vs EUSS (?)

EEA Family Permit Denied - EEA vs EUSS (?)

Hi Everyone,

Needless to say I'm a little confused.

My EEA Family Permit / EUSS Family Permit (?) was denied for the following reason:
On 23 August 2019 you made an application for an EU Settlement Scheme (EUSS) Family
Permit under Appendix EU to the Immigration Rules on the basis of your family life with your
sponsor.

Your application has been refused because you have not provided a Home Office reference
number (or the equivalent in the Islands) to show that your EEA or Swiss citizen family
member has settled or pre-settled status under the EU Settlement Scheme.
All other information seemed to be in line and I was refused for something that I must have overlooked. I am the non-EU spouse of an EU citizen who is studying in the UK for her Masters Degree. I was under the impression that I was applying for an EEA Family Permit, but they continue to call it an 'EUSS Family Permit.' Is there a difference? If so, I was not aware and sent in my application as if it were an EEA Family Permit. Perhaps I made a mistake on my cover sheet?

What reference number are they talking about? My wife is cleared to go there for University and actually arrived there today, but was there a number she was given for 'pre-settled status' that I should have applied with?

Any help or advice would be greatly appreciated. Once I correct the mistake, I intend to re apply immediately.

I'm always fascinated by people who don't enjoy reading opened and government sources :)

If you go to: https://www.gov.uk/family-permit this will help you getting to know what you were applying for.

The reference number they are talking about, to the best of m knowledge, only applies to EU settlement route. If you read a bit further the website, you'll understand they are talking about unique reference number your partner received (?) when she applied for her pre-settled status.

An EEA family permit is an application made outside the UK. You were advised of this in June, so unclear what exactly you applied for and on which form.

Within the UK you either apply for pre settled status under appendix EU or an EEA 5 year residence card ender the EU directive.

Haha, you're talking to someone who has been working on this application for months and honestly believed that they covered every single corner. I'm aware of what the Settlement Scheme is and that it's not what I am applying for. What I don't understand is that there is no way I would have selected that in my online application if EEA Family Permit was also an option. I'm thinking it must have been a mistake I made on my cover sheet since I copied it from someone else's.

Correct. I am outside of the UK and applied for what I believed was the EEA Family Permit, not the EU Settlement Scheme.

No offence, but your initial post was a bit hmmm... too uncertain about everything, so possibly led me to wrong conclusions.

I can only think of one way you made this mistake (if the mistake is not on their side): you followed the wrong link on gov.uk. I don't have any other explanation

Yeah, sorry for being defensive. Realistically you probably can't be far off. I think in the initial stage of the application I must have made a mistake and applied for the EUSS and not the EEA. Either way, the blame can only be put on myself here. I'll just have to wait until my documents return so I can correct the mistakes that I've made. It's embarrassing after having spent all this time trying to submit a bullet proof application.

The good news is that at least they didn't question the validity of our marriage, which was something I felt would be hard to fight, as I've heard in other experiences. Hopefully I'm not speaking too soon!

If you are applying via EU settlement scheme your sponsor has to have already settled or pre- settled status and link their application number with your application.
