applying for spouses outside immigration rules

Post by Anu4real » Wed Nov 27, 2019 12:56 am

i am on limited leave to remain as the primary carer of a british child ( my child lives with me ) i meet my now wife when she came over to do her masters degree, we are now both married, i know i cant file for spouse visa for her since i still have temporary resident, i earn over the £18,600 requirement, i am looking to apply for her outside the immigration rules, my childs mother is still in the uk and moving to my home country will mean that her contact visit granted by the courts will be affected, as it is i cant be out of the country for more than 28 days with her without informing the court or her mother, i cant travel often to visit my wife in our home country as well as that may effect the number of days i am allowed out of the united kingdom in a particule year, i wanted to know if she would still need to do a test of english exam (she just completed her masters ) we stay in council flat given to us by the council and she pays as a non-dependant,
question 2 is there anything else we would need to provide ?
question 3 is there anything else aside her getting pregnant (which we are not ready for ) to help make our case stronger ?

See the guidance linked below for this type of application, which should help answer questions 2 and 3. There is not a lot of detail on what to provide and it seems like it would be up to you to determine what would be relevant to support the application.

A Master's degree completed in the UK would usually be sufficient to satisfy any English language requirement. Another option to consider might be appl

Looks like you could apply using the FLR(FP) form if you feel that is the closest match to your circumstances. An FLR(FP) application should also be assessed by the Home Office to whether a refusal would be a breach of ECHR Article 8. The guidance states that "if an applicant in the UK wishes to be considered solely outside the Immigration Rules, they should apply using the FLR(HRO) application form or FLR(IR) form. Applicants should indicate that they are applying for other purposes not covered by other application forms".
