Financial requirements 6 months consecutive or any bank statment within 12?

Dear All,

Need your kind input here. I'm a self-employed British looking to apply for a spose visa for my wife but after reading the the 80 pages requiment booklet I found the rules to be overly complex and confusing.

Here is my first quetion with regards to my circumstances under the financial requirments it states I need to provide 6 months of bank statment. Here is my quetion I have been away on travel for a couple of months which means I have no earnings during these times to send, does the 6 month bank statment rule has to be consecutive monthly bank statment for the last 6 months from the date I submiited my application? Or I can provide any bank statment from any of the 12 months of the year from the date I submitted my application?

If you are self-employed you should stick to the information in Section 9 from page 60 onward, the rest likely doesn't apply to you.

Amongst the many other pieces of specified evidence for self-employment listed on pages 64 and 65 of the guidance document, you will have to provide "personal bank statements for the same 12-month period as the tax return(s)". For self-employment, you will have to use income received in the last full financial year (Category F) or average of the last two full financial years (Category G) to meet the financial requirement. The bank statements will have to be for the 12 consecutive months of the full financial year, though you do not necessarily have to have received income in every month in order to satisfy the financial requirement using these categories.

Thanks for clearing up this for me. Think I got this one covered as I can provide this financial year of tax return and 12 months of bank statment which will satisfiy the £18600 yearly income requirment after tax. If I'm missing some thing please let me know.

My second quetion is this, Under the requerments it states that Income from Housing Benefit, Council Tax Benefit amoung others will not be counted towards the financial requirement. Due to my earning was low befor I was paying a discounted Council Tax and was reciving housing benefit, but recently as my financial circumstances changed and my earning went up since the last couple of months I've been paying Council Tax and no longer reciveing Housing Benefit. Now my quetion is how all of this affect my application?

You will need to rely on the financial year and it will depend on when you intend to apply for example currently the most recent financial year for a sole trader will be April 18 to April 19. You have to provide evidence within that period as well as bank statements for the same period showing all income received. They will rely on your gross taxable profit.

Council tax benefits are not permitted source of income when applying under self employed except when you receive any disability etc and in that case, it will be counted as part of your income to meet the requirement under adequate maintenance.
