CONFUSION ABOUT BRITISH NON DEPENDANT CHILD (SPOUSE VISA)

Post by mashy71 » Sat Feb 08, 2020 7:10 am

Hi,

New on here so hope I am posting in the right place! Apologies if not.

So, been married to my husband for 21 years. During this time I have lived abroad with him (UAE)

I have a daughter aged 31, british citizen, who is in the UK. My husband got a job here in the UK (Tier 2 visa) and we moved back here last april. We are now applying to switch to spouse visa. However there is a question on the form that I am confused about. The question is 'Does your spouse (me, british citizen) have any children who are not applying on the application?' We selected yes, but then it asks lots more questions including Why is the child not living with you? (she's 31 fgs and now has a child of her own) and where is the childs father and how often does she see him?

Do I continue with this question or just select the 'NO' answer when asked if I have any children as she is not technically a child?

Hoping to get an answer and thanks

In a different application that I've been filling in myself, there were 2 separate questions: common children with your spouse and children of your spouse apart from common. And indeed for the second "kind" of kids, there were all the various questions re another parent.

One other thought is whom do they call "child\children"? Is there any definition or information box? Possible they restrict the age to 21-25 years.

I'm not familiar with Spouse visa form, but is there a way that the above also applies to it? If you are sure that there was no tick that you missed or question that might have been misinterpreted, I see no harm in answering "she is 31 and lives on her own" (maybe skip "fgs" part).
