Tier 4 to Partner Visa (Both parties are students)

Post by HazzaV » Fri Oct 02, 2020 3:05 pm

Hi everyone,
I'm needing some help on this as every site I've looked at seem to completely ignore this.

I am a British citizen and am a full time Uni student. My fiancee is a Chinese citizen at Uni in the UK on a Tier 4 student visa. We are planning on getting married soon, followed by applying for her to remain in the UK on a Partner visa. We are planning this route as her potential job prospects are hugely limited by the requirement of a Tier 2 visa sponsor.

If anyone has any knowledge or experience with this situation it would be super appreciated.

Hello

You may get married in the UK. That's won't be an issue.

But yourself as a student, you are not in position to sponsor her. As you need to give proof of earnings and accommodation. Usually people don't struggle with the accommodation side but the financial requirements are often an issue.

You need to demonstrate that you earn at least £18'600 a year. Otherwise, she would have to leave the UK even if you are married.

I agree with your comments on the Tier 2. It's hard to get that when you just left the Uni.

Otherwise, you may still go to any EU country of your liking and sponsor her as an EU citizen yourself. You can still do that before Dec 2020.

If none of the options above talks to you, then refrain from marrying at the moment because she will go to China.

Would job positions secured for after graduation be taken into consideration?
