I am switching from Tier 2 Dependent to FLR M. My husband has just received his ILR via 10 year route. There are bunch of questions in the form which are confusing. Any help would be really appreciated -
1st Question - On what basis did you apply for your current visa, leave to enter or remain or other permission?
- As the partner of a British citizen, settled person or a person with refugee leave or humanitarian protection in the UK
- As the child of a British citizen, settled person or a person with refugee leave or humanitarian protection in the UK
- As the parent of a British citizen or settled child who is under 18, or who was under 18 when you were initially granted leave in this category and was not living an independent life
- As an adult coming to the UK to be cared for by a relative who is a British citizen, settled person or a person with refugee leave or humanitarian protection in the UK
- Private life in the UK
- Leave outside the Immigration Rules, including on the basis of compelling or compassionate circumstances or an Article 8 claim
- Medical grounds or ill health
- Discretionary leave
- None of the above, or I'm not sure
I have selected "None of the above" as I am switching from PBS Dependant which I am not sure if is considered as a Spouse visa or not.
2nd Question - Please choose the reason you are applying for an extension, this includes if you are switching to a partner visa from another type.
- First extension as a partner (following an initial period of entry as a partner, or as a fiancé(e) or proposed civil partner of a settled person)
- Additional extension as a partner
- First application as a partner from within the UK (for example, you are currently in the UK on another type of visa or permission to stay)
- You delayed your travel to the UK by more than 3 months after the issue of a visa and have not yet completed the required amount of time on a partner visa (not including as a fiancé(e) or proposed civil partner)
- You require more time to meet the Knowledge of Language and Life in the UK requirements to apply for settlement
- You were granted entry as a fiancé(e) or proposed civil partner, but have not yet married or entered into a civil partnership
- You are applying for any other reason
I have selected "Any other Reason" and then mentioned switching from PBS dependent to FLR M.
3rd Question - Is you current entry of clearance as a partner of Settled Person or British Citizen?
I have selected No as my current visa is PBS dependant and my husband has just received his ILR.
Also me and my husband got married in June 2014 in India, but I moved to UK in July 2015. I lived in Yorkshire from July 2015 to Septemeber 2015 but I moved to Reading for a job in October 2057 while my husband was still in Yorkshire finishing his PHd. He moved to Reading with me after he was done with his PHd in April 2017. Do we need to mention this gap in the application as they asked evidences of co-habitation for 2 years only.
Apologies for multiple questions but I am intending to apply tomorrow hence it is little urgent. Thank you all in advance.
