Hello,
I made ILR application on 1 September 2019 via post. And received decision letter on 3rd April 2020 saying that they have granted ILR. The date on the letter is 31 March 2020. They posted out BRP in separate cover on 6th April 2020. Due to covid19 lockdown the offices were closed and missed the delivery. The BRP returned back to Home office in May 2020. I am assuming that Date of issue on BRP should be 31 March 2020 (as per decision letter).
When I chased the BRP, Home Office said they have it. Then they said they re-issued BRP card and sent to me. I got BRP card on 29th October 2020 and and the Date of issue is now 26th October 2020.
SO my question is if they have granted me ILR in March 2020 and issued BRP in March 2020, how can they change the date now.
Can I raise this as a mistake to BRP unit?
Any suggestions really appreciated.
Many thanks,
-

Do you have your Home Office ILR approval letter dated in March?
If yes, then it is not an issue. The issue date on the card is the date it was issued not the date your ILR immigration status was granted.
PS: Keep safe your ILR approval letter as that will be your proof if you plan to apply for citizenship after 1 year as per Section 6(1).

Many thanks CULLINAN.... Yes, I have decision letter from Home Office dated 31 March 2020, which says ILR granted.
My son was born in May 2020. Can I use this letter to apply for his first UK passport?
Many thanks again..

Ok this is interesting. HMPO requires your original BRP.
If you go by the BRP issue date, then your baby is not British by birth which is wrong.
You should write a cover letter and explain to HMPO.
Is the ILR decision letter original received in post?

Yes, I have original decision letter received in post and dated 31st March 2020. They issued me BRP and sent on 8th April, with date on BRP must be before 8th April 2020. Just missed the delivery due to covid lockdown.
Now they sent me new BRP with new date 26th October 2020.
I am confused. I will write cover letter to HMPO to explain this.
Many thanks.

You will have to send original ILR approval letter and your original BRP to HMPO with an explanation. Your baby is born British and your ILR approval letter/BRP is baby’s claim to British Citizenship.
NOTE: You are advised NOT to return your original ILR BRP, even after your naturalisation (if you plan to) AND do not discard your original ILR approval letter. Keep both safe for your baby’s future sake.
Assuming your baby was born in UK??

Many thanks CULLINAN. I will write to HMPO and send original decision letter. Should I just give BRP details like BRP number, issue date etc. in the cover letter? Instead of sending the original BRP.
Yes, my son was born here in UK.
Thanks.,

Approval letter alone is not the proof of your immigration status. HMPO requires original documents.
I would advise you to send both. In your case, you need to provide an explanation to HMPO.
If BRP was dated in April, original BRP alone would have been enough.
