Question regarding debt as a Spouse Sponsor

Post by LeeUKSponsor » Tue Nov 24, 2020 9:40 pm

Hello everyone

I scoured the forum before finally registering as I didn't see anything that quite matches my question.

I have recently been speaking to a debt advisor but wanted to get as much information as possible before making a decision.

I am currently in debt to the tune of £20k, with the calculations from the debt advisor it is going to be possible for me to save enough money to cover the costs of reapplication and everything else that applies to my wife being and staying here. My question is, would entering into a debt arrangement scheme disqualify me from being a sponsor? I know that bankruptcy would disqualify me for certain, and the advisor spoke to their supervisor and said that a trust deed is likely to affect an application as well, but they said they don't believe that a debt arrangement scheme would, as the debts will be paid in full (eventually) and it is a private protected agreement.

Does anyone else have any experience in this matter? Obviously I believe the advisor but they also said that researching as much as possible was advisable, given that the decision has the potential to very negatively impact our living situations but after many google searches and lots of reading, both my wife and I have turned up blanks.

My wife did find advice for tier 2 and tier 5 sponsors from the home office and section 12.14 states "If you enter into a debt management plan or a debt arrangement scheme (DAS) and there is no change in ownership, you can continue to hold your sponsor licence." so we are wondering if this would apply as a spouse sponsor as well.

Any help is appreciated.
